1. Definitions

1.1 Company - refers to Drain Kings Ltd.

1.2 Customer -  means the individual or business requesting the Company’s services.

1.3 Services - refers to drainage, plumbing, maintenance, repairs, CCTV inspections, emergency callouts, and any other related work performed by the Company.

1.4 Contract -  means the agreement between the Customer and the Company for the provision of Services.

2. Formation of Contract

2.1. A Contract is formed when the Customer accepts a quotation, signs a service agreement, or instructs the Company (verbally or in writing) to commence work.

2.2. All Contracts are subject to these Terms and Conditions, which take precedence over any other terms, unless otherwise agreed in writing by a Director of the Company.

3. Quotations & Pricing

3.1. All quotations are valid for 30 days unless otherwise stated.

3.2. Prices quoted are exclusive of VAT unless otherwise specified.

3.3. Estimates are provided based on visible and accessible conditions. If additional work is required due to hidden issues or regulatory compliance, the Company will inform the Customer and provide revised costs.

4. Emergency Callouts

4.1. Emergency work is charged at the prevailing hourly or fixed call-out rate at the time of the request.

4.2. The Company reserves the right to charge an out-of-hours or weekend rate.

4.3. Payment for emergency callouts is typically due upon completion unless prior credit arrangements have been made.

5. Access & Customer Responsibilities

5.1. The Customer shall provide access to the premises and ensure a safe working environment.

5.2. The Customer must disclose any known hazards or previous issues that could affect the delivery of Services.

5.3. The Company shall not be held liable for delays or additional costs caused by restricted access, safety concerns, or withheld information.

6. Cancellations & Delays

6.1. Cancellations must be made with a minimum of 24 hours’ notice. The Company reserves the right to charge a cancellation fee if adequate notice is not given.

6.2. In the event of delays due to weather, availability of parts, or unforeseen circumstances, the Company will inform the Customer and reschedule at the earliest opportunity.

7. Workmanship Guarantee & Liability

7.1. The Company provides a 12-month workmanship guarantee on most services, unless otherwise stated.

7.2. This guarantee does not cover blockages that reoccur due to misuse or unrelated issues, nor damage caused by third parties or acts of nature.

7.3. Materials and parts are guaranteed in accordance with the manufacturer’s warranty.

7.4. The Company’s liability is limited to the value of the work provided. The Company shall not be held liable for indirect or consequential losses.

8. Payment Terms

8.1. Invoices are due within 7 days of the date of issue unless agreed otherwise in writing.

8.2. The Company reserves the right to charge interest on late payments at 8% above the Bank of England base rate under the Late Payment of Commercial Debts (Interest) Act 1998.

8.3. All materials supplied remain the property of the Company until full payment is received.

9. Use of CCTV Footage & Reports

9.1. Where CCTV surveys are provided, the footage and reports remain the property of the Company until payment is received in full.

9.2. The Company may retain a copy of all footage for legal, training, or quality assurance purposes.

10. Insurance & Accreditations

10.1. The Company holds public liability insurance up to £5,000,00

10.2. Copies of insurance certificates and professional accreditations are available upon request.

11. Complaints Procedure

11.1. In the event of dissatisfaction, the Customer should contact the Company in writing as soon as possible.

11.2. The Company will investigate and respond within 10 working days.

11.3. If the matter remains unresolved, the Customer may refer the complaint to a relevant trade association or alternative dispute resolution body.

12. Data Protection & Privacy

12.1. The Company collects and processes personal data in accordance with the UK GDPR and Data Protection Act 2018.

12.2. Customer data will only be used to provide services, issue invoices, and communicate about work.

12.3. The Company will not sell or share personal data with third parties except where legally required or with the Customer’s consent.

13. Force Majeure

13.1. The Company shall not be held liable for failure to perform its obligations due to events beyond its reasonable control, including but not limited to acts of God, extreme weather, strikes, or material shortages.

14. Governing Law

14.1. These Terms and Conditions are governed by the laws of England and Wales.

14.2. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
